A Memphis man convicted in the 2002 shooting death of an Iraqi man in North Memphis agreed Monday to a sentence of life in prison without parole after his death penalty was reversed by a judge last year.
Devin Earl Banks, 29, had been on death row since his conviction seven years ago in the execution-style murder of acquaintance Kadhem Al-Maily, 39, and the critical wounding of Hussain Altilebawi, then 36.
His convictions were upheld, but last year Special Judge Walter Kurtz ruled that Banks' defense team was ineffective in the sentencing phase when the Criminal Court jury gave Banks the death penalty instead of life in prison.
