In Tennessee, a panel of the federal court of appeals has lifted a stay of execution. On Saturday I posted that while the Tennessee governor had dissolved his moratorium following the revision of the state's lethal injection procedures, a federal judge had stayed a scheduled execution. Philip Workman is scheduled to be executed early tomorrow morning. Karl Keys has this at Capital Defense Weekly:
Workman TRO lifted 2-1 by Sixth Circuit
The Sixth Circuit has lifted the TRO enjoining this week’s scheduled execution of Phillip Workman in Tennessee. The en banc motion is here, with related materials here. The quality of counsel in Workman has been superb and its pleadings serve to give a great insight in to the lethal injection “scrummages” nationally. [Note that the Tennessee Supreme Court will post the Sixth Circuit’s en banc order here when it is published.]
