At issue is the timing of a defendant's right to counsel. The Texas Fair Defense Project is counsel for Walter Rothgery. Here's what TFDP said about the case last month:
The issue in Rothgery is critical for indigent defendants, who are dependent on the courts for access to counsel. In many Texas counties, individuals arrested for criminal offenses and bound over for trial wait months before a defense attorney is appointed.
