The Federal Public Defender's Office in Phoenix has withdrawn its petition to a federal appeals court over Arizona's execution procedure.
Thursday's move comes after Arizona corrections officials announced they now will allow execution witnesses to watch as prison staff insert catheters into the condemned inmate.
Dale Baich says his office wanted clarification that lawyers will be among those allowed to see the IV process before withdrawing its petition to the 9th U.S. Circuit Court of Appeals in San Francisco.
Arizona's new policy will begin with the scheduled June 27 execution of Samuel Villegas Lopez by lethal injection.
