Polk Circuit Judge Donald Jacobsen ruled Tuesday that he won't stop the July 10 execution of condemned killer Eddie Wayne Davis.
Jacobsen denied Davis' appeal, rejecting his argument that a possible blood disorder could interfere with the drugs the state uses in lethal injections, causing him pain and violating the Constitutional prohibition on cruel and unusual punishment.
"In this case, the defendant has not met his heavy burden to establish that he is ‘sure or very likely' to experience serious illness or needless suffering," Jacobsen wrote in his ruling.
Jacobsen's ruling will be automatically appealed to the Florida Supreme Court.
