A U.S. appeals court on Wednesday vacated a stay of execution for a triple murderer that Missouri wants to execute before midnight.
The order takes effect after 6 p.m. (2300 GMT) and gives inmate John Middleton the opportunity to petition for a rehearing of his case, according to the ruling issued by the 8th U.S. Circuit Court of Appeals.

The 8th U.S. Circuit Court of Appeals ruled Wednesday that the execution could proceed, but Middleton's attorneys appealed to the U.S. Supreme Court.
Missouri law allows a 24-hour window for executions. That means if Middleton has not been executed by midnight Thursday, the Missouri Supreme Court would need to set a new execution date.
